Foyen advises when Blekinge district court dismisses HFAB’s claim in dispute with JSB Construction
In its judgment, the District Court ruled that HFAB's claim should be dismissed in its entirety. HFAB is also ordered to compensate JSB Construction AB's legal costs of just over SEK 5.1 million.
Blekinge District Court recently issued a judgment in the dispute between Halmstads Fastighets AB (HFAB) and the contractor JSB Construction AB regarding alleged moisture damage in three apartment buildings on Sofiebergsvägen in Halmstad. The District Court agrees with JSB Construction AB and rejects HFAB's claim for compensation. The dispute, which concerned extensive moisture penetration in properties built in 2013, was initiated when HFAB filed a lawsuit against JSB Construction AB in 2023 and claimed just over SEK 9.8 million in compensation. HFAB referred to an investigation that alleged serious construction defects.
In its judgment, the District Court ruled that HFAB's claim should be dismissed in its entirety. HFAB is also ordered to compensate JSB Construction AB's legal costs of just over SEK 5.1 million and to bear its own costs of approximately SEK 2.4 million.
